    Nancy,  Last Thursday we were approved by the MNCPPC
    Planning Board.  Thank you for all of your assistance.  Please
    pass on to the board and the HOA my thanks for their cooperation.  Contact me if any questions come up.   I do not foresee any development occurring until the end of this year or early next.  I
    will still keep you informed as we proceed through this process. 
    The preparation of detailed plans take time and the
    review process is even longer.

    Re: Update of Property on Lullaby Road

    Nancy, Our scheduled May 4th Site Plan Hearing has been
    pushed back 2 weeks to May 18th. MNCPPC planners are being
    very careful and want to be extra thorough before they take a
    project to the Planning Board. I still want to reiterate to you and
    the HOA that we intend to annex our project into the Village of
    Oak Hill Community Association. If you could send me a
    confirmation that this is still the intent of the Association (and
    forward a copy to MNCPPC) we can offer this as part of the record. Also, MNCPPC is now looking for confirmation that HOA’s
    adjacent to proposed projects are aware of the proposed plans
    and of their proposed MPDU (Moderately Priced Dwelling Units)
    units. If this could be included in a letter along with the HOA’s
    overall opinion of the project (support or otherwise) that would be appreciated.  Please let me know if there are any questions
    that the HOA may have in regards to our plan. Again, I will
    keep you posted of Hearing information.

    MNCPPC Planning Board hearing for both the Preliminary and
    Final Site plans.  Nothing has changed on the plans since I last delivered them to you.
     
    As we get closer to the date, I will send a confirmation of the

    BOD,

    Mike Fisher called and said the June 17th hearing went well with 
    the Hearing Examiner.  No one in attendance was in opposition to 
    the plan.  The report will take 30-60 days to complete and then the report will go before the County Council for approval.

    Board recommends changing business park into townhouses

    County Council to decide zoning request
    The Planning Board recommended allowing an exchange of jobs
    for townhouses Thursday in the reclassification of 4.5 Germantown acres. The land, located at the intersection of Lullaby Road and
    Father Hurley Boulevard, is currently zoned for technology/
    business park development and was expected to provide about
    100 new jobs. However a developer has submitted plans for 29 townhouses on the site instead.  The long, narrow piece of land
    was once part of the B&O Railroad alignment and is near the
    CSX railroad line. It is proposed to be developed as part of the Kinsgview Ridge subdivision. The property would feed into
    Northwest cluster schools. Joe Lavorgna, director of school
    planning, estimated 16 additional students from the townhouses
    and said the cluster was capable of accommodating the change.
    The board's recommendation was forwarded to the hearing
    examiner who will hold a hearing June 17. The final decision on reclassification will be made by the County Council.  The Planning Board received several letters from the community about the development, including one from Germantown Alliance expressing support and one from Gaithersburg-Germantown Chamber of
    Commerce expressing concern.  There were also two letters
    from the leadership of nearby Village at Oak Hill Association. Community manager Nancy Keen wrote May 19 that while the association supported the development, there were concerns
    about parking, traffic, landscaping and other issues. Keen said the association would like to annex the new development to "allow for continuity and a sense of community."

     

  • The Office Of Zoning and Administrative Hearings has rescheduled 
    the Hearing regarding the Lullaby Rd. (Germantown Station) lot.  
    The new date and time will be June 17, 2005 at 9:30 am.  This 
    date was rescheduled because the staff did not have an adequate amount of time to complete its technical staff report and recommendation.  The complete file in this matter is available for 
    review at the Office of Zoning and Administrative Hearings, 2nd 
    Floor, Werner Office Building, 100 Maryland Avenue, Rockville, 
    Md.  M-F between 8:30am and 5:00pm.

          Nancy,

          I just received in the mail Thursday's (June 2nd) MNCPPC agenda, 
          and we are Item 6.  It is scheduled to be heard between 10:15 and 
          12:00 in the morning.  It is recommended for approval by the 
          planners with a maximum density of 29 units.  This is for the 
          rezoning request.  After this will come the Hearing Examiner on 
          June 17th and then the County Council (to be determined later).  
          After that we still have the site plan approval process with  
          MNCPPC.
